The recent decision in Network Rail Infrastructure Ltd v Williams and another [2018] EWCA Civ 1514 confirms that landowners who fail to take reasonable steps to control the spread of Japanese Knotweed from their property can face claims for actionable nuisance is a timely reminder that the presence of this species on your land should not be taken lightly. Thankfully there is a great deal of research going on in to how to control (if not quite ever eradicate) this natural survivor.....
