This recent case has seen the affordable housing viability pendulum swing firmly in the direction of local authorities and it will rightly be scaring those developers who have paid too much for a site. However, with the right advice taken before sites are bought, there is no reason why schemes should not go ahead and if there is more chance of them being policy compliant the application costs will be less and the process faster.
